Large amounts of workers are involved, developers sometimes propose a barter system where the contractor is compensated not with cash, but with a finished property unit in every project they helped build. This is precisely what led to the present crisis.

The deal and the denial

According to the police complaint, the contractor’s firm was brought on board to execute essential structural and finishing work for a housing development in the western suburbs of Mumbai. The total verified value of this labour amounted to approximately ₹9.57 crore. To settle this debt, an agreement was signed, promising the contractor a sizable flat within the same building, valued at several crores of rupees.

The contractor fulfilled his obligations, completing the high-value construction work as per the contract. The problems began when it was time for the developer to uphold his end of the bargain. Despite the contractor’s successful completion of the construction, the developer allegedly refused to transfer the ownership of the promised flat or issue the outstanding payment.

The situation was reportedly complicated further when the developer allegedly requested the contractor to accept a cash discount on the agreed-upon amount and then pushed for a convoluted exchange involving property in a different, struggling project. In one instance, the contractor was allegedly coerced into spending his own money, including taking out loans, to secure essential permits for a separate development, all under the false promise of finally receiving his due property.

Threats over payment

As the debt remained unpaid and the promised apartment was continually with held, the contractor demanded the financial settlement he was owed. The response he received was not a promise of payment, but an aggressive denial and threats. The developer allegedly warned the contractor against asking for the money again, using intimidation and forcing the victim off the site.

This situation reveals a troubling pattern where a powerful developer can exploit smaller firms. In the complaint, the contractor stated he learned that his experience was not unique and that the developer’s family had allegedly used similar methods to cheat other contractors and associates in the past.

The police have arrested the developer and a close associate, moving the case into the court system.

This arrest sends a clear signal that law enforcement is taking action against financial fraud in the construction sector, while the industry is vital to urban development, it often struggles with issues of delayed payments, broken promises, and complex legal battles.
