MahaRERA crackdown: New rules to protect homebuyers

The Maharashtra Real Estate Regulatory Authority (MahaRERA) has introduced a new set of rules aimed at ensuring that homebuyers finally get the compensation they are owed. For many years, buyers with delayed possession, stalled projects or refund orders struggled to receive the relief granted to them. Many developers simply ignored the orders, leaving buyers in a long wait. The new Standard Operating Procedure (SOP) has been created to change that.

Under the updated process, developers must pay compensation or refunds within 60 days of a MahaRERA order. If they fail to do so, strict actions can now follow. The most significant step is the option of civil imprisonment for up to three months for builders who continue to ignore compensation orders without a justified reason. This makes the system more accountable and gives the buyer stronger support, another important part of the SOP is the requirement for developers to submit a detailed list of their assets if they delay payments, this includes all movable and immovable properties, bank accounts and investments. If a developer refuses to submit this information, MahaRERA can take stronger legal steps, including referring the matter to the civil court. The court can then decide on possible seizure of assets or other enforcement measures.

The process for buyers has also been simplified. If compensation is not received within 60 days, buyers can file an application asking for enforcement. MahaRERA has been directed to hear such applications within four weeks. This ensures that cases do not remain pending for years, as seen earlier.

The reason for these changes comes from the growing concern over a large number of unresolved cases. According to reports, there are more than 2,000 execution cases where developers have not complied with earlier orders. The Bombay High Court had also expressed concern over delays and weak enforcement. The new SOP has been introduced to create a clear, time-bound system that works smoothly for both buyers and the authority.

The updated rules aim to restore confidence in the real estate sector, for buyers, it brings hope that their long-pending dues will finally be resolved. For developers, it serves as a reminder that ignoring legal orders is no longer an option. At the same time, the SOP encourages fair play by giving builders structured timelines and clarity on expectations.

Industry experts say the new rules may improve transparency and accountability in the market. With better enforcement, buyers may feel more secure while investing in new homes. It may also encourage developers to maintain financial discipline and complete their projects on time.

Overall, the new MahaRERA SOP marks an important step toward creating a fairer real estate environment in Maharashtra. It focuses on timely action, transparency, and real relief for homebuyers who have waited far too long.
